Elgin Sheriff Court hears former Moray resident attempted to defecate and urinate on Kinloss residents’ property
A man who attempted to defecate and urinate on the doorstep of a house in Moray just one day after being granted bail for a separate matter has been given a five month custodial sentence.
James Wilson, formerly of Buckie, appeared via video-link at Elgin Sheriff Court on October 3 from HMP Low Moss where he is serving a custodial sentence for a domestic matter until January 2025.
The court heard that on the evening of February 6 this year, witnesses spotted Wilson on CCTV outside their home in Kinloss.
The 40-year-old was staying with family at a house nearby at the time and the witnesses were aware of this.
But upon going to investigate what Wilson was doing, he started shouting.
Procurator fiscal Victoria Silver said it was not clear to the witnesses what Wilson was shouting, only that it was an “aggressive tirade” directed towards them.
He was asked to leave and police were contacted.
However, he returned to the property and he could be seen trying to urinate on the front doorstep of the house.
Wilson was unable to do so but then dropped his trousers before attempting to defecate on the garden path to the property.
Police viewed the CCTV footage and Wilson was identified, cautioned and charged.
Defence solicitor Matthew O’Neill told the court that his client accepts that his actions were “beyond foolish”.
He added that Wilson had been out for the night prior to the incident and had been assaulted that day.
He was only at the address, which Mr O’Neill said he rarely frequents, after police had left him with family following his assault.
He had been drinking heavily and was “worse for wear” and his attempts to urinate and defecate on the property were intended to be of a “jokey manner”, according to the solicitor.
Mr O’Neill added: “He neither urinated or defecated but obviously making out that he was doing so caused alarm.
“What was said was not understood but there is no excuse for his behaviour and he accepts that.
“After the allegations he removed himself from the local area but he has no recollection of the incident.”
Wilson had been granted bail just one day prior to the incident.
Sheriff David Harvie said: “You’re 40 years old. Schoolchildren wouldn’t behave like this.”
Wilson was given a five month custodial sentence to run concurrently with his other sentence starting from October 3.
