Elgin domestic abuser avoids jail, tradesman placed on sex offenders register and Moray mums banned from driving - Court round-up





It has been another busy week of covering court in both Elgin and Inverness.

Here, we have rounded up some of the most notable cases over the past seven days.

A man from Elgin has been told he is “going to kill a woman one day” after he admitted to assaulting his partner three times within the space of a week.

Elgin Sheriff Court heard that 27-year-old Kyle Mackenzie assaulted his partner on multiple occasions between October 14 and October 19 this year.

Sheriff Gordon Fleetwood had little sympathy for Mackenzie, whom defence solicitor Matthew O’Neill said had been struggling with his mental health at the time, labelling him a “nasty, unthinking and vile man”.

A mum of three who collided with a wall after attending a ladies day has been disqualified from driving.

Elgin Sheriff Court heard that on October 26 this year witnesses in Keith heard a noise outside their home.

Upon investigation, they found that a vehicle had collided with a wall on Church Street.

Within the vehicle was 37-year-old Danielle Lawson who was said to be “confused”.

Police conducted a roadside specimen test which gave a reading of 115 micrograms of alcohol in 100 millilitres of breath. The legal limit is 22 micrograms of alcohol per 100 millilitres of breath.

A tradesman who exposed his genitals to a female client has been placed on the sex offenders register for one year.

Dennis Francis, of Manitoba Avenue in Elgin, started his window cleaning business in 2001.

But the 61-year-old’s livelihood and marriage were left in tatters after he exposed himself to a client he had known for two years.

Francis admitted to pulling down his shorts to expose his penis in a “sexual manner” to the 49-year-old client at an address in Mosstodloch during an incident on August 27 this year.

A man and a woman attacked a bus driver in broad daylight after being told off for pressing the vehicle’s buzzer too often.

Dean Wells of Kingsmills, Elgin, and first offender Chloe Ross, of Chesworth Gardens, also Elgin, appeared for sentencing at Inverness Sheriff Court.

Wells had previously admitted assault and robbery and threatening behaviour while Ross pleaded guilty to an assault.

However, Sheriff Eilidh Macdonald, who had already deferred sentence for background report, did so again - until February 17, 2025.

A mother of two has received a lengthy driving ban after being caught drug-driving through Elgin.

On May 24 this year police officers stopped a vehicle driving along Reiket Lane at around 12.35am while on patrol.

The officers spoke to the sole occupant of the vehicle, later identified to be 37-year-old Toni Mackenzie of Hossack Drive, Elgin, and observed her as being “jittery” and “picking at her skin”.

A test revealed that Mackenzie had 129 micrograms of cocaine per litre of blood in her system.

Mackenzie’s defence solicitor told Elgin Sheriff Court that her client’s circumstances at the time were “sensitive”.
